These Terms form a legally binding agreement between you and ResuPulse and apply whenever you access our website, create an account, upload content, or use any resume analysis, AI-powered career, or related platform features. By continuing to use the Service, you acknowledge that you have read and understood these Terms.

2. Description of the Service

ResuPulse provides AI-powered career tools designed to help users improve resumes, optimize job application materials, and better understand resume quality based on commonly accepted recruiting and Applicant Tracking System (ATS) practices. Depending on product availability, the Service may include:

• AI-powered resume analysis and ATS compatibility scoring
• Keyword and skills gap identification
• Section-by-section resume feedback
• AI-generated resume improvement suggestions
• Resume building, comparison, and optimization tools
• Cover letter generation
• LinkedIn profile optimization tools
• Additional AI-powered career features introduced over time

AI-generated results are intended to provide guidance and educational insights. They are generated using automated systems and should not be relied upon as professional legal, employment, recruiting, or career advice. Resume scores, ATS evaluations, and recommendations may differ from the evaluation methods used by employers or specific Applicant Tracking Systems.

3. Eligibility

You must be at least 16 years old, or the minimum legal age required in your jurisdiction to use the Service. By using ResuPulse, you represent and warrant that you satisfy these eligibility requirements and have the legal capacity to enter into this agreement.

4. User Accounts

4.1 Account Creation (Optional)

Many ResuPulse features can be used without creating an account. If you choose to register, you agree to provide accurate, current, and complete information and to keep your account information updated when necessary.

• Provide accurate, current, and complete registration information.
• Maintain the confidentiality of your password and login credentials.
• Notify us promptly if you believe your account has been accessed without authorization.

4.2 Account Responsibilities

You are responsible for all activity carried out using your account. To help protect both your account and the Service, you must not:

• Share your account credentials with other people.
• Access or use another person's account without permission.
• Create multiple accounts to bypass platform limits or restrictions.
• Attempt to impersonate another individual or organization.

5. Acceptable Use Policy

You agree to use ResuPulse responsibly, ethically, and only for lawful purposes. You must not use the Service in any way that could harm other users, compromise platform security, or violate applicable laws.

• Abuse the Service: Generate excessive requests, scrape content, or automate access in a way that negatively affects platform performance.
• Upload Harmful Content: Upload malware, viruses, malicious scripts, or any content intended to disrupt the Service.
• Violate Applicable Laws: Use ResuPulse to create fraudulent resumes, misrepresent qualifications, or engage in unlawful activity.
• Infringe Intellectual Property or Privacy Rights: Upload or process content that you do not have permission to use.
• Reverse Engineer the Service: Attempt to discover, reproduce, extract, or misuse proprietary software, prompts, algorithms, or other confidential technology.
• Generate Spam or Phishing Content: Use the platform to produce deceptive, abusive, or unsolicited content.

6. User Content

6.1 Your Uploaded Content

You retain ownership of the resumes and other content you upload. By submitting content to ResuPulse, you grant us a limited, non-exclusive license to process, analyze, and display that content only as necessary to provide, maintain, and improve the requested Service.

6.2 AI-Generated Content

AI-generated scores, rewrites, recommendations, and other outputs are provided for informational purposes. Subject to applicable law, you may use, modify, or disregard these outputs. ResuPulse does not claim ownership of AI-generated content created for you through the Service.

6.3 Responsibility for Submitted Information

You are solely responsible for ensuring that the information you submit is accurate, lawful, and that you have the necessary rights and permissions to upload it. ResuPulse does not independently verify resume content and is not responsible for inaccurate, misleading, or unlawful information submitted by users.

7. Intellectual Property

7.1 Our Intellectual Property

The Service, including its software, user interface, visual design, branding, documentation, algorithms, databases, and other proprietary materials, is owned by ResuPulse or its licensors and is protected by applicable intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, sell, or create derivative works based on the Service.

7.2 Trademarks

"ResuPulse", our logos, product names, and related branding are trademarks or distinctive brand assets of ResuPulse. You may not use them without our prior written permission, except where permitted by applicable law.

8. Disclaimer of Warranties

To the fullest extent permitted by applicable law, ResuPulse is provided on an "as is" and "as available" basis without warranties of any kind, whether express, implied, statutory, or otherwise.

While we continuously work to improve the reliability and quality of the Service, we do not guarantee that it will always operate without interruption, meet every user's expectations, or be suitable for every hiring process or employment situation.

In particular, we do not warrant:

• That the Service will always be uninterrupted, secure, available, or free from errors.
• That AI-generated scores, suggestions, or recommendations will always be accurate, complete, or appropriate for your circumstances.
• That using ResuPulse will result in interviews, job offers, promotions, or other employment opportunities.
• That ATS scores or compatibility assessments will match the evaluation methods used by any employer, recruiter, or Applicant Tracking System.
• That all platform features or third-party services will remain available at all times.

AI systems can make mistakes. You should carefully review, verify, and edit any AI-generated content before relying on or submitting it. ResuPulse is not responsible for errors, omissions, inaccurate suggestions, or decisions made based on AI-generated output.

9. Limitation of Liability

To the maximum extent permitted by applicable law, ResuPulse and its affiliates, officers, employees, contractors, licensors, and agents shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to your use of the Service.

This limitation includes, without limitation:

• Loss of profits, revenue, business opportunities, or goodwill.
• Loss, corruption, or unavailability of data.
• Damages resulting from your use of, or inability to use, the Service.
• Reliance on AI-generated scores, recommendations, or resume analysis.
• Rejected job applications, unsuccessful interviews, hiring decisions, or other employment outcomes.
• Actions, services, or decisions provided by third-party providers or integrations.

Where permitted by law, our total aggregate liability for all claims arising out of or relating to the Service shall not exceed the greater of USD 100 or the total amount you paid to ResuPulse during the twelve (12) months immediately preceding the event giving rise to the claim.

10. Indemnification

You agree to defend, indemnify, and hold harmless ResuPulse and its affiliates, officers, employees, contractors, licensors, and agents from and against any claims, liabilities, damages, losses, costs, and reasonable legal expenses arising from or relating to:

• Your use or misuse of the Service.
• Your violation of these Terms or applicable laws.
• Your infringement of another person's rights.
• Content that you upload, submit, generate, or distribute through the Service, including inaccurate, unlawful, or misleading information.

11. Account Suspension and Termination

We may suspend, restrict, or terminate your access to all or part of the Service if we reasonably believe that doing so is necessary to protect the platform, comply with legal obligations, or enforce these Terms.

This may occur if you:

• Violate these Terms of Service.
• Engage in fraudulent, abusive, deceptive, or unlawful activity.
• Use the Service in a manner that negatively affects other users or system availability.
• Attempt to bypass platform security or usage restrictions.

12. Changes to the Service

Those third-party services are governed by their own terms, privacy policies, and business practices. ResuPulse is not responsible for the availability, content, policies, security practices, or performance of third-party services, except where required by applicable law.

14. Dispute Resolution

We encourage resolving concerns through open communication before pursuing formal legal proceedings. Most issues can often be resolved more quickly through direct discussion.

14.2 Arbitration

Unless otherwise required by applicable law, disputes arising out of or relating to these Terms or your use of the Service shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996 of India. The seat and venue of arbitration shall be in India unless otherwise agreed by the parties or required by applicable law.

14.3 Individual Resolution of Claims

To the extent permitted by applicable law, you agree that disputes will be resolved on an individual basis and not as part of a class action, class arbitration, consolidated proceeding, or representative action.

15. Governing Law

These Terms of Service are governed by and interpreted in accordance with the laws of India, without regard to its conflict of law principles. Subject to any applicable arbitration requirements and mandatory legal rights, the courts of India shall have jurisdiction over matters relating to these Terms.
